Climate Change and the Constitution: A New Era?

In the landmark case of Urgenda Foundation v. The State of the Netherlands, the Dutch Supreme Court upheld a decision that required the government of the Netherlands to reduce its greenhouse gas emissions by at least 25% compared to 1990 levels. Could Canadian courts follow suit? To explore the emerging area of climate change litigation, we speak with Dennis van Berkel, legal counsel to the Urgenda Foundation, as well as Dayna Nadine Scott, associate professor at York University and York Research Chair in Environmental Law & Justice in the Green Economy.
